Terms and Conditions

These Terms and Conditions govern the use of the VKB Equipments website and the purchase of goods or services from VKB Equipments. They apply to agricultural equipment, construction machinery, trailers, implements, attachments, parts, accessories, used goods, salvage items, and related services.

Using the website, placing an order, accepting a quotation, or making payment indicates acceptance of these terms together with our Privacy Policy, Payment Policy, Shipping Policy, Return Policy, Refund Policy, and any written warranty or quotation.

Nothing in these terms excludes a right that cannot lawfully be excluded under South African law.

Customers should confirm critical specifications before ordering. Product dimensions, capacity, weight, operating hours, and compatibility should not be assumed where they have not been expressly confirmed in writing.

Availability

Displaying a product does not guarantee current availability. Used equipment, salvage products, and one off items may be sold before the website is updated.

VKB Equipments may withdraw, replace, or update products before accepting an order.

Used and Salvage Goods

Used and salvage goods may show wear, corrosion, repairs, scratches, faded paint, dents, replaced parts, and signs of previous operation.

Known material faults will be disclosed where reasonably known. A used product will not necessarily provide the appearance, efficiency, remaining service life, safety features, or manufacturer support of a new equivalent.

Customers buying high value used machinery should inspect the equipment or appoint a qualified independent inspector.

Compatibility

Customers must provide accurate machine details when requesting parts or attachments. These may include the make, model, serial number, engine number, part number, measurements, photographs, and configuration.

VKB Equipments may assist with identification based on the information supplied. We cannot guarantee compatibility where the details are incomplete, inaccurate, or relate to a modified machine.

Quotations and Orders

A quotation remains valid for the stated period and remains subject to stock availability, supplier changes, exchange rates, and transport costs.

An order becomes binding after VKB Equipments confirms availability, verifies pricing, receives required information, receives cleared payment or an agreed deposit, and issues written acceptance.

We may reject an order before acceptance where stock is unavailable, pricing contains an obvious error, payment cannot be verified, delivery is impractical, or the transaction presents a fraud risk.

Payment

VKB Equipments accepts EFT and credit card payments. Goods will generally not be released until cleared payment has been received.

Delivery and Collection

Delivery arrangements are governed by our Shipping Policy and accepted quotation. Delivery dates are estimates unless guaranteed in writing.

Customers must provide an accurate address, safe access, a responsible recipient, and suitable unloading arrangements. Collection must be arranged in advance, and the vehicle must be appropriate for the load.

Ownership and Risk

Ownership remains with VKB Equipments until all amounts due have been paid in cleared funds, unless otherwise agreed in writing.

Risk may pass to the customer on delivery, collection, handover to the customer’s carrier, or another point agreed in writing.

Installation and Operation

Equipment and parts must be installed, operated, inspected, and maintained by competent persons in accordance with manufacturer instructions, rated capacities, safety procedures, and applicable regulations.

Customers are responsible for operator training, licences, protective equipment, machine guarding, workplace safety, and site controls.

Warranties

Any express warranty will be stated in the listing, quotation, invoice, manufacturer documentation, or separate warranty document.

Warranty coverage may be refused where failure results from incorrect installation, misuse, overloading, contamination, unsuitable fluids, poor maintenance, accident, unauthorised repair, or operation outside stated specifications. Statutory rights remain unaffected.

Liability

To the extent permitted by law, VKB Equipments will not be liable for indirect or consequential loss, including lost production, lost profit, machine downtime, crop loss, missed contracts, penalties, rental expenses, or loss of opportunity.

Nothing excludes liability or consumer rights that cannot legally be excluded.

Complaints and Law

Complaints should be sent to sales@vkbequipments.co.za with the invoice number, product details, dates, and a clear description.

These terms are governed by the laws of South Africa. Disputes may be referred to an appropriate court, regulator, tribunal, commission, ombud, or other body with jurisdiction.

Changes

VKB Equipments may update these terms when business practices, technology, products, or legal requirements change. The version applying to a sale will normally be the version in effect when the order was accepted.
